COR400000 - General Construction Permit Renewal

As required under the Clean Water Act amendments of 1987, the Environmental Protection Agency (EPA) has established a framework for permitting municipal and industrial stormwater discharges. The Colorado program is called the Colorado Discharge Permit System (CDPS).

The division has permit regulations (5CCR 1002-61) that require stormwater discharges from construction activity to be covered under a permit. This includes all construction activity that results in land disturbance equal to or greater than one acre or disturbance of less than one acre of total land area that is part of a larger plan of development or sale if the larger common plan will ultimately disturb equal to or greater than one acre.

The construction stormwater discharge general permit expired on March 31, 2024. The division issued the renewal permit on January 31, 2024, which became effective April 1, 2024. The effective COR400000 permit, fact sheet, and response to comments are now available. The renewal permit outlines compliance with water quality standards via practice-based limitations and requirements and includes updates to add clarity.

The division’s compliance guidance documents have been updated in accordance with the permit that became effective on April 1, 2024, and is available to assist permittees in complying with the newly effective permit.
